What Are the Waiting Periods for Legal Insurance in Austria?

Most legal insurance policies in Austria include waiting periods (Wartezeit). A waiting period means you cannot claim for disputes that arise within this period after taking out the policy. This prevents people from signing up only when they already have a legal problem. You must sign up before you need it.

Plan Ahead

Because of waiting periods, you should sign up for legal insurance as soon as you move to Austria. Do not wait until you have a dispute. If you sign up after a dispute has already started, the insurer will reject the claim.

Can You Choose Your Own Lawyer, and What If Cover Is Refused?

In Austria, free choice of your own lawyer is legally guaranteed by section 158k of the Insurance Contract Act (VersVG). Your insurer may recommend a law firm, but you are not bound by that recommendation. You can appoint any lawyer you trust to represent you.

If the insurer refuses to cover a case, you are not stuck with that decision. Under section 158n VersVG, you have a right to an arbitrator's decision or arbitration to review the refusal. This process checks whether the case has a reasonable chance of success.

You can also escalate a dispute to the FMA (Financial Market Authority), which runs a complaint office for insurance disputes. Filing a complaint with the FMA is free and can help resolve conflicts without going to court.

What Is NOT Covered by Legal Insurance in Austria?

Legal insurance does not cover every type of legal dispute. Before you rely on your policy, be aware of these common exclusions:

  • 1.Pre-existing disputes: Any dispute that existed before the policy started or within the waiting period is not covered.
  • 2.Family law: Divorce, custody, and alimony disputes are excluded from most standard plans. Some providers offer a separate family law add-on.
  • 3.Intentional criminal acts: If you are accused of a crime you committed intentionally, legal insurance will not cover your defense.
  • 4.Construction defects: Disputes related to building or renovation defects are usually excluded from standard policies.
  • 5.Small disputes under the deductible: Most policies have a deductible (Selbstbehalt) of EUR 200 to 500. Disputes below this amount are not covered.
