Finding Housing in Austria (2026)

Updated: | Found helpful by 109 others
New rental listings in Vienna ask a median €22.45 per m² including operating costs, so a 35 m² flat runs about €786 a month. Expect a deposit of 3 months' gross rent. A tenant answering an advert pays €0 broker fee under the Bestellerprinzip (§ 17a MaklerG). Since 1 January 2026, fixed-term leases from business landlords must run at least 5 years. Register your address (Meldezettel) within 3 days of moving in.

Where Can You Search for Apartments in Austria?
| Portal | Strongest for | Watch out for |
|---|---|---|
| willhaben | The most private landlords without an agent, Nachmieter flats, and cooperative flats passed on with a Finanzierungsbeitrag (one 90 m² flat in the 10th district asked €24,412.26) | Advance-payment scams and fake listings with stolen photos; furniture Ablöse demands (around €5,000 is not unusual) are negotiable and unprotected |
| ImmoScout24 | Agency listings with floor plan and energy certificate; its network carries about 100,000 listings and 2.3 million users a month (Q1 2026) | Mostly agents, so payslips are near-certain; some listings stay online as bait after letting |
| derStandard.at Immobilien | Vienna, Graz and Linz flats in an edited setting, with a tenancy-law guide | Smaller volume and many duplicates of ImmoScout24 listings |
| Immowelt | A familiar interface for movers from Germany | Few Austrian listings; German legal texts (deposits in net cold rents) do not apply here |
| Wohnberatung Wien and developers | Subsidised new builds direct from non-profit developers, with no commission | Income limits and an upfront financing contribution; Vienna council flats need 2 years of main residence for the Wohn-Ticket |
The most popular platforms for finding rental apartments in Austria include:
- Willhaben.at: Austria's largest classifieds platform. The go-to site for apartment listings, with both private and broker listings.
- ImmobilienScout24.at: A major real estate platform with detailed search filters for location, price, size, and amenities.
- Immowelt.at: Familiar to movers from Germany, but with far fewer Austrian listings. Its guides sometimes describe German rules: Austria's broker rule is § 17a MaklerG, and deposits are counted in gross monthly rents.
- derStandard.at Immobilien: The newspaper's portal. Smaller than willhaben, with fewer scam listings and a tenancy-law guide next to the ads.
- Facebook Groups: Groups like "WG-Zimmer & Wohnungen Wien" or "Expats in Vienna" often have direct listings from landlords without broker fees.
- wg-gesucht.de: Popular for shared flats (Wohngemeinschaften or WGs), especially among students and young professionals.
For families and longer stays, the Genossenschaft route is the one newcomers overlook. Non-profit developers let new flats without commission and at cost-based rents well below the open market, in exchange for an upfront Finanzierungsbeitrag. In Vienna, the city's Eigenmittelersatzdarlehen loan can cover that contribution; it has to be applied for within 3 months of signing, via wien.gv.at. Council flats (Gemeindebau) are closed to new arrivals until they have 2 years of continuous main residence in Vienna.
Which Renting Route Fits Your Situation?
| Situation | Best route | Why, in numbers |
|---|---|---|
| Just arrived, €900 budget, Vienna | willhaben private and Nachmieter listings, or a WG room as a bridge | At the €22.45/m² Vienna asking median, €900 buys about 40 m². Have 3 gross monthly rents ready for the deposit |
| Student, €500 budget, Graz | ÖH housing board and WG-Gesucht, or a student residence | At €15.15/m², €500 covers about 33 m² on the open market, so a shared flat is the realistic option |
| Agent asks you for 2 months' commission | Pay €0, cite § 17a MaklerG, ask to see your written mandate | If the landlord hired the agent first, a tenant commission is void and refundable |
| Family, 3 rooms, Salzburg | Genossenschaft flats plus private listings | 75 m² at the €21.96/m² asking median is about €1,647 a month; cooperative rents sit far below that |
| 8-month work project | Furnished second-home lease or a sublet with written consent | A second home for a temporary job move may be leased for up to 6 months outside the MRG |
| Non-EU, no Austrian payslips, Linz | Guarantor, foreign employment contract and bank statements | No law requires payslips. Linz is the mildest big-city market at €15.51/m², down 4% on a year earlier |
| Fixed-term lease ends, you want to stay | Negotiate a written extension 3 to 6 months ahead | The landlord need not extend. If nobody acts, the lease renews once, then becomes open-ended |
| Deposit kept without receipts | Schlichtungsstelle (Vienna: free) or the AK | The deposit is due back without delay, plus interest under § 16b MRG |
Rent figures are median gross asking rents per m² from the ImmoScout24 listing analysis for January to April 2026. Flat sizes and monthly totals are our own arithmetic. Asking rents run well above signed rents.
The route that works depends less on the city than on budget, contract length and paperwork. A newcomer with no Austrian payslips does better with private landlords on willhaben than with agency listings, which almost always ask for 3 payslips. Anyone staying under a year cannot get a normal main tenancy at all, because the MRG minimum fixed term is 3 or 5 years.
The gap between asking and signed rents matters for budgeting. Statistik Austria put the average rent actually paid across all Austrian tenancies at €10.50/m² including operating costs in Q1 2026, or €695.10 per flat. That average includes council and cooperative flats, which is why new listings in Vienna cost roughly twice as much per square metre.
What Documents Do Landlords Ask For, and Which Are Legally Required?
| Document | Status | What it means for a newcomer |
|---|---|---|
| Passport or photo ID | Legally required for registration | You need it for the Meldezettel, so landlords ask for a copy |
| Meldezettel | Legally required, but only after you move in | A consequence of the lease, not a condition for it. A landlord asking for one before move-in is asking for the impossible |
| 3 payslips or employment contract | Customary, not legal | Some private landlords accept a foreign contract plus bank statements |
| Guarantor (Bürgschaft) | Customary as a substitute | A landlord may ask for one but need not accept it. A parent or employer is the usual guarantor |
| Residence permit (non-EU) | Not a tenancy-law requirement | Matters in practice, and for Vienna's housing benefit, which needs 5 years of lawful residence |
| Household insurance | Not legal, often written into the lease | Check the contract before signing; see liability insurance |
No Austrian statute tells a landlord which documents to demand. The only legally required paper in the whole process is your photo ID for the registration, and the Meldezettel itself comes after the lease. Everything else, payslips, a guarantor, a KSV1870 extract, is market custom that a landlord may ask for and you may offer substitutes for.
Speed still decides most viewings (Besichtigung). Popular Vienna flats collect dozens of enquiries within hours and many listings are gone in under 48 hours. Bring a folder with ID, your employment contract and recent bank statements to the viewing, so you can apply on the spot. Never pay a deposit or a "reservation fee" before signing: that is the most common scam pattern on open classifieds.
How Much Is the Deposit (Kaution) and Who Pays the Broker Fee?
| Deposit | Rule (§ 16b MRG and practice) |
|---|---|
| Usual amount | 3 gross monthly rents. No statutory ceiling; around 6 is treated as the critical upper end in practice |
| How it must be held | Cash deposits go into an interest-bearing savings book or an equally safe, separate investment. On request the landlord must tell you in writing how it is held |
| Interest | Belongs to you and comes back with the deposit |
| Repayment | Without delay (unverzüglich) after the tenancy ends, minus only justified claims: unpaid rent, damage beyond wear, open operating costs |
| Landlord insolvent | You can claim the savings book separately (§ 48 IO), so it is not lost to other creditors |
| House with 1 or 2 flats | Outside the MRG, so no statutory duty to invest it. Agree the terms in the contract |
| Who hired the agent (§ 17a MaklerG) | Tenant pays | Landlord pays |
|---|---|---|
| Landlord hired the agent first (the normal case) | €0 | Up to 3 gross monthly rents + 20% VAT |
| You hired a search agent first, lease 3+ years or open-ended | Up to 2 gross monthly rents + 20% VAT | Nothing |
| You hired a search agent first, lease under 3 years | Up to 1 gross monthly rent + 20% VAT | Nothing |
| Agent linked to the landlord, or advertised the flat with the landlord's consent | €0, even with your own mandate | As agreed |
The deposit is typically 3 months' gross rent, meaning base rent plus operating costs, without VAT and heating. On a 55 m² Vienna flat at the €22.45/m² asking median, that is €3,705, and with the first month's rent you need about €4,940 in cash before you get the keys. Under § 16b MRG the landlord must invest it separately and return it with interest.
The broker fee is simpler than its reputation. § 17a MaklerG lets an agent agree a commission with a flat seeker only if the seeker hired them first. A tenant who answers an advert owes €0, and any clause shifting the landlord's commission to the tenant is void. Agents who break the rule face fines of up to €3,600, and money already paid can be reclaimed. The oesterreich.gv.at commission page sets out the caps.
Before 2023, tenants routinely paid up to two months' rent in Provision. Watch for the workarounds that replaced it: a viewing fee, a reservation fee, or a request to sign a "search mandate" after the agent has already shown you an advertised flat. None of these shift the commission to you. An Ablöse for furniture from the outgoing tenant is legal but negotiable, and you pay it at your own risk.
If you do hire your own search agent, three details limit the bill. A simple brokerage contract can be cancelled at any time without notice. An exclusive mandate (Alleinvermittlungsauftrag) binds a consumer only if it is in writing and time-limited, in practice up to 3 months for a rental. A contract signed online or outside the agent's office can be withdrawn within 14 days under the FAGG, or up to 12 months and 14 days if you were not told about that right. If a lease of under 3 years is later extended past 3 years or made open-ended, the agent may charge 1 further gross monthly rent.
How Long Must a Fixed-Term Lease Run Since the 2026 Change?
| Rule (flats under the MRG) | From 1 January 2026 | Before 2026 |
|---|---|---|
| Minimum fixed term | 5 years from a business landlord, 3 years from a private one | 3 years for everyone |
| Term too short | The lease counts as open-ended | Same |
| Tenant leaves early | After 1 year, with 3 months' notice to month-end, so the earliest exit is the end of month 16 | Same |
| Written extension | As often as agreed, each time at least 5 or 3 years | At least 3 years |
| Nobody acts at expiry | Renews once for 5 or 3 years, then becomes open-ended | Renewed once for 3 years |
| Rent discount for a fixed term | 25% off the Richtwert rent (fully regulated flats only) | Same |
| Landlord ends an open-ended lease | Only through a court, for a reason listed in § 30 MRG | Same |
Since 1 January 2026, a fixed-term flat lease from a business landlord must run at least 5 years, under § 29 MRG. Private landlords who are not a business under the KSchG may still offer 3 years. A shorter term does not shorten your stay: the lease simply becomes open-ended. You keep the right to leave after the first year with 3 months' notice.
Who counts as a business landlord is decided case by case; property companies and landlords letting several flats commercially usually qualify. Leases signed before 2026 keep their agreed end date, but any extension now follows the new minimums. The oesterreich.gv.at page on fixed-term leases explains the transition.
The 25% fixed-term discount (§ 16 Abs 7 MRG) is the figure tenants most often miss. It applies only to fully regulated Richtwert flats, mostly pre-1945 Altbau. If your fixed-term Altbau rent was set without it, the overpayment can be reclaimed through the Schlichtungsstelle or the courts. The AK Wien checks leases for free.
What Are Your Rights as a Tenant in Austria?
Austria has strong tenant protection under the Mietrechtsgesetz (MRG), which applies in full to most buildings built before 1945 and to subsidised housing. The Arbeiterkammer provides free legal advice on tenant rights. Key protections include regulated rent increases, protection against eviction without a court order, and the right to challenge excessive rent at the Schlichtungsstelle (arbitration board). Newer buildings (Erstbezug) are less regulated, and rents follow the market.
Always read your rental contract (Mietvertrag) carefully. If possible, have it reviewed by the Mieterhilfe in Vienna or a similar organisation in your city. The contract should list the base rent (Hauptmietzins), operating costs (Betriebskosten) and any additional charges. The operating-cost statement is due by 30 June of the following year; repairs and renovation may not be passed on to you.
How Do You Register Your Address (Meldezettel)?
| Registration | Deadline | Cost and detail |
|---|---|---|
| Meldezettel (main or secondary residence) | Within 3 days of moving in | €0. Form signed by the landlord plus photo ID. Missing the deadline risks a fine of up to €726, €2,180 if repeated |
| ORF household levy | Automatic once you register a main residence | €15.30 a month in Vienna, Lower and Upper Austria, Salzburg and Vorarlberg; Styria adds €4.70. Since 2026 a paper payment slip (Erlagschein) covers the whole year at once (€183.60); instalments run only by SEPA direct debit |
| Electricity and gas | On move-in day | Photograph meter readings and numbers at handover; compare tariffs with the E-Control calculator |
| Mail forwarding (Nachsendeauftrag) | About 3 working days before the move | Paid by duration, for 3 to 12 months, at Österreichische Post |
| EU citizens staying over 3 months | Within 4 months of arrival | Anmeldebescheinigung, at MA 35 in Vienna; check the current fee there |
Within 3 days of moving in, you must register your address (Meldezettel) at the local registration office (Meldeservice or Gemeindeamt), as oesterreich.gv.at sets out. Bring the form signed by your landlord and your passport. A landlord who refuses to sign commits an offence, and the office registers you anyway.
The Meldezettel unlocks most of what follows. You need it to open a bank account, get a phone contract and register with health insurance. Registering a main residence also triggers the ORF levy automatically, so expect the first bill within weeks.
What Do Vienna Renters Report About Deposits and Agents?
The disputes renters describe cluster in two places: deposits held back at move-out, and agents testing the Bestellerprinzip with fees under other names. The common thread in the replies is evidence. A signed Übergabeprotokoll with dated photos wins deposit disputes, and the free Schlichtungsstelle is the first stop before any lawyer.
What residents report
- − Deposit kept in full: Four flatmates leaving an 80 m² new-build after 18 months say the landlady kept the whole €6,000 deposit and billed €4,000 more, including full repainting and replacing parts instead of repairing them. Commenters accepted some wear claims but called the total grossly inflated. (r/wien, 2026)
- ○ 75% of deposit withheld: A Vienna tenant asked whether keeping three quarters of a deposit is normal practice. Most replies said no and pointed to the Schlichtungsstelle, because it costs nothing and carries no risk of paying the other side's costs. (r/wien, 2025)
- − Worn keys billed to tenant: A property manager wanted to deduct the cost of copying three worn keys from a deposit. The thread agreed that normal wear is not tenant damage and advised objecting in writing. (r/wien, 2026)
- − Deposit asked before signing: Someone asked if paying the deposit before signing the lease is normal. Replies said it is a classic scam or pressure pattern: pay only against the signed contract or the key handover. (r/wien, 2024)
- + €1,600 broker fee demanded: A flat seeker was asked for a €1,600 commission just as the Bestellerprinzip was announced. Commenters explained that a tenant who never hired the agent owes nothing under the new rule. (r/wien, 2022)
- + Viewing fee from an agent: A reader asked whether an agent may charge for a viewing. The consensus was no: without a prior search mandate from the tenant, an agent cannot bill expenses either. (r/wien, 2025)
- ○ Hiring your own search agent: Tenants weighed hiring their own agent. The thread noted that this legitimately costs 1 to 2 gross monthly rents and is worth it only on a very tight deadline; otherwise answer adverts and pay nothing. (r/wien, 2026)
- + Cooperative vs private flat: A Vienna couple who spent two years in a Genossenschaft flat said it was larger per square metre, had an extra room and was more modern than the private rental they had before. (r/wien, 2024)

Frequently Asked Questions
Do I have to pay a broker fee when renting in Austria?
Not if the landlord hired the agent first, which is the standard case. Since 1 July 2023, § 17a MaklerG lets an agent agree a commission with a tenant only if the tenant was the first to commission them. A tenant answering an advert owes €0. Commission paid unlawfully can be reclaimed, and a disguised tenant mandate is void.
How long must a fixed-term lease run in Austria since 2026?
For flats under the MRG, at least 5 years if the landlord is a business (Unternehmer under the KSchG) and at least 3 years if it is a private landlord, under § 29 MRG as amended from 1 January 2026. A shorter term makes the lease open-ended. The tenant may still give notice after the first year, with 3 months' notice to the end of a month.
When must the landlord return my deposit?
§ 16b MRG says without delay (unverzüglich) after the tenancy ends, plus the interest the deposit earned. The landlord may only keep what is needed for justified claims from the tenancy, such as unpaid rent or damage beyond normal wear. If they hold it back without proof, the Schlichtungsstelle handles the dispute free of charge in cities that have one.
Can a landlord demand a Meldezettel before I move in?
They often ask, but it is not possible: you can only register an address after you have moved in, within 3 days. No statute requires payslips either. What landlords customarily ask for is a passport, 3 recent payslips or an employment contract, and sometimes a guarantor. A foreign employment contract plus bank statements is accepted by some private landlords.
Can I rent a flat in Austria for less than a year?
Only outside the main tenancy rules. § 1 Abs 2 Z 3 MRG exempts a second home leased for at most half a year because of a temporary job move. Otherwise the minimum fixed term applies, so short stays run through sublets (with the main tenant's and often the manager's written consent), furnished temporary rentals or student residences.
When do I get my Genossenschaft financing contribution back?
Within 8 weeks of handing the flat back. § 17 WGG gives a departing cooperative tenant a refund of the Grund- und Baukostenbeitrag paid on top of the rent, due within 8 weeks of vacating (Abs 3). It shrinks by 1% a year (Abs 4), counted from the building's occupancy permit, not from your move-in. A €20,000 contribution on a 10-year-old building comes back as about €18,000. The landlord may first offset justified claims from the tenancy.
What is Vienna's Eigenmittelersatzdarlehen?
A City of Vienna loan that pays the Grund- und Baukostenbeitrag on a subsidised flat. It runs at a fixed 1% for up to 25 years, with repayments starting after year 5. The building must be at most 25 years old and the flat at most 150 m². You must be 18+, an Austrian or EU citizen or hold a valid residence permit, and earn below the Förderstufe 4 limit: €89,440 net a year for a family of four (2026). Apply within 3 months of signing; the application is free.
